Dear user: CCB has updated the Personal Information Protection Policy. The updates mainly include: 1. How the Bank collects your personal information; 2. How the Bank uses your personal information.

China Construction Bank Corporation (hereinafter referred to as the “Bank” or “we”) is fully aware of the importance of personal information to you and will do its best to protect your personal information security. We devote ourselves to retaining your trust in the Bank and protecting your personal information pursuant to the principles of rights commensurate with obligations, clear purpose, informed consent, necessity, safety assurance, openness and transparency, integrity and information quality. In addition, we undertake to take appropriate security measures to protect your personal information in accordance with laws.

 

This Personal Information Protection Policy will help you know:

I.How does the Bank collect and use your personal information?

Personal information refers to any information recorded by electronic or other means that is related to an identified or unidentified natural person. Personal information includes but is not limited to the customer’s name, gender, nationality, occupation, address of residence or workplace, contact information, type of ID or identification document, ID number and ID validity. If the leakage, illegal provision or abuse of any information may endanger personal or property safety and easily cause damage to personal reputation and physical or mental health or incur discriminatory treatment, such information is deemed as sensitive personal information, mainly including ID number, personal biometric information, financial account, communication record and content, property information, credit record information, whereabouts, accommodation information, health and physiological information, transaction information, specific identity, and personal information of juveniles under the age of 14.

i.How to collect information

To provide services to you while ensuring the security of the e-CNY, we will collect the information provided by you or generated in your use of the e-CNY services:

1.When you enable the e-CNY wallet, according to laws, regulations and regulatory requirements, we will collect your mobile phone number, user nickname, real name, ID type (ID card/passport/Exit-Entry Permit to Hong Kong and Macao), ID number, ID validity, ID photocopies, bank card number, mobile linked with bank account, recipient’s name of transfer and wallet ID, so as to help you complete the sign-up for e-CNY wallet and use the e-CNY wallet management, information inquiry, transfer and other basic services. If you refuse to provide such information, you may not be able to enable the e-CNY wallet or use CCB’s basic services.

2.Pursuant to the state laws and regulations and regulatory requirements on anti-money laundering, financial sanctions, and our business policies for customer identification and customer information collection, we will continuously identify and verify the compliance of your personal information, including basic identity details, and take effective management measures such as due diligence and termination of services.

3.In using the e-CNY functions or services in, for example, the following circumstances, you may need to provide or authorize us to collect the user information necessary for provision of relevant services. If you refuse to provide information necessary for some functions or services, you will be denied access to such functions or services. But such denial will not affect your access to other e-CNY functions or services.

(1) For your safe and convenient use of the e-CNY wallet, we may read the content of the SMS message which sends you the verification code to help you enter the verification code. If you refuse to authorize access to such communication information (SMS), the e-CNY wallet will not read the SMS content which will thus not be saved in the system background.

(2) If you choose to log in to the e-CNY wallet, transfer, make payment and verify your identity via the function of fingerprint or facial verification, you shall provide your face image data to us or authorize us to use the fingerprint and facial verification function of your device.

The application of facial verification includes e-CNY wallet upgrade, quick card linking, password resetting and e-CNY APP login. If you do not provide your facial verification information, we will be unable to provide you with products only available after facial verification.

The application of facial verification includes payment and transfer. You can enable or disable one or more of these functions via “My - Account & Security”. We will not collect your facial information for facial verification. Your facial information is only stored on the device you have authorized and you can update such information through the facial verification function on your device.

The application of fingerprint verification includes e-CNY wallet upgrade, payment, transfer, quick card linking, password resetting, and e-CNY APP login. You can enable or disable one or more of these functions via “My - Account & Security”. We will not collect your fingerprint. Your fingerprint is only stored on the device you have authorized and you can update your fingerprint information through the fingerprint verification feature on your device.

For the local biometric authentication functions provided by the mobile terminal of some brand or model, such as facial verification, relevant information will be processed by the mobile terminal provider. We will not retain the information in the related function of your mobile terminal.

(3) When you use the e-CNY wallet to transfer money to a mobile number (with China Mobile, China Telecom or China Unicom as the operator) and make payment to your friend in the list of contacts, you shall authorize us to read your contacts. We will only read the name and mobile number of the contact you have selected and encrypt and transmit the information to the server. Other contact information will not be read or reported. The above information is sensitive personal information. If you do not use the above functions, you may choose not to provide such information, which will not affect your access to other functions of the e-CNY wallet.

(4) To make any transfer, top-up, deposit to bank or QR code payment, you shall provide the recipient’s mobile number, name, wallet ID/account number, bank name and purpose. You may be asked to provide your name, mobile number, ID type and ID number to verify your identity and access the above payment service. In addition, we will also collect your corresponding payment and collection transaction records for your future inquiry. The above information is sensitive personal information. If you refuse to provide such information, you will be denied access to the above functions. But it will not affect your access to other functions of the e-CNY wallet.

(5) To use the identity verification service provided by the e-CNY wallet, you may be required to provide your mobile phone number, user nickname, real name, ID type (ID card/passport/Exit-Entry Permit to Hong Kong and Macau), ID number, contact address, gender, nationality, occupation, ID validity, ID photocopies, fingerprint authentication information, facial verification information and device information. We may also check the validity of relevant information by verifying account number/card password, mobile linked with bank account and SMS verification code. If you do not provide the above information, we will be unable to provide you with products or services only available after identity verification.

(6) When you use geographical location-based service, we will collect your network location information for the purpose of providing you with the location-based service. If you refuse to provide such information, you will be denied access to the above services. But it will not affect your access to other functions of the e-CNY wallet.

(7) When you use the e-CNY wallet, we will collect your transaction information and create a recipient list to simplify your transfer operations. If you choose the SMS one-time password (OTP) as the authentication tool, we will send the SMS OTP to your registered mobile number to verify your e-CNY wallet transaction.

(8) When you manage your wallet information via the e-CNY APP, we may verify your APP login password, wallet payment PIN and SMS verification code of the registered mobile number for your wallet. To ensure the security of your account funds, we will verify your name, ID number and facial information, and you will be required to provide your registered mobile number and SMS verification code when you reset the wallet payment PIN.

(9) To send cash red packets with the e-CNY APP, you need to choose a type of red packet according to the page prompt, enter the mobile numbers of the recipients or allow the APP to access your contacts from which the recipients are selected, and then enter the amount and the quantity of red packets. If you do not provide the aforesaid information, some types of red packet cannot be sent out, but other types of red packet and our other services are free of influence. If you choose to send group red packets, you can share links with the selected third parties through our functional components. Group red packets can be claimed by clicking links according to the page prompt.

(10) When others claim the red packets you sent, we will display your real name (if red packets are sent with the identity-verified wallet) or e-CNY wallet name (if red packets are sent with the anonymous wallet) to help them confirm your identity. When you claim the red packets sent by others, we will also show your real name (if you claim red packets with the identity-verified wallet), e-CNY wallet name, and mobile number (the last four digits; if you claim red packets with the anonymous wallet) or masked mobile number (if you do not have an e-CNY wallet or an e-CNY APP account) to those who send the red packets, helping them confirm your identity. Meanwhile, your e-CNY wallet name and mobile number (the last four digits) or masked mobile number will also be visible to the persons who claim the same red packets as you. To claim red packets by clicking links through the selected third-party platform, you should authorize the relevant page to display your third-party platform username, e-CNY wallet name, and mobile number (the last four digits) or masked mobile number.

4.When you use the e-CNY service, we will collect the following basic information to maintain service continuity and ensure your account security: your device model, operating system, unique device identifier, e-CNY wallet version number, login IP address, network access mode, type and status, network quality data, device accelerator (such as gravity sensor), operation log, service log information (such as information you searched and viewed in the e-CNY wallet and service failure information), and geographic location information. Such information is the basic information that must be collected to ensure your proper use of our service. Due to the differences in the categorization of the operating system access of different manufacturers, some mobile phones put the “Unique Device Identifier” under “Phone – Call Status or Mobile Network Information” or “Mobile Phone – Mobile Number and Call Status”. However, we will not read the call history or status of your mobile phone.

5.To provide you with more accurate, personalized and convenient services, or to prevent risks, we will collect the information of your feedback, suggestions or complaints and collect the information on the types of the e-CNY functions or services you have used, the way you use them and related operations as well as your user information retained at the Bank. We will statistically process and analyze such information and provide you with appropriate services or products based on such information.

6.When you use any third-party service in relation to e-CNY, we will not share your personal information with the third party unless you separately authorize and agree. For the information that you provide to a third party in using the third-party service, we will regard it as that you have allowed the third party to access the above information. For the information generated when you use the third-party service, it is your and the third party’s responsibility to reach an agreement on the collection and use of the above information in accordance with the law. If you refuse to authorize the third-party service provider to collect, use or transmit the above information, you may be denied access to relevant third-party service for e-CNY. But such denial will not affect your access to other e-CNY functions.

7.You can choose whether to authorize us to collect and use your personal information under the following circumstances:

(1) The camera for QR code verification, facial verification, OCR verification, e-CNY APP login, e-CNY wallet upgrade, payment, transfer, and password resetting. Without your authorization, the above functions will be unavailable. We will store the collected data, such as facial information, in the system background database after encryption.

(2)The contact list for transfer and payment without manual entry of the phone number of the recipient. It helps you quickly select phone numbers from your contacts. Without authorization, transfer will still be available, but you will need to enter the phone number. Our mobile banking only reads and records the specified phone number, and it does not read your full contact list.

(3) The SMS on your mobile. We may read the SMS verification code to help you fill in the verification code where such code is required. Without authorization, our mobile banking will not read the SMS content and the system background will not store the SMS content.

(4) The geographic location for the provision of corresponding services for you in the place where you are. The location information of your transaction will be stored in the system background. Without authorization, relevant functions of our mobile banking will be unavailable.

(5) Reading the list of installed APPs for scanning whether your mobile has been installed with the e-CNY APP. Without authorization, the APP check function will be unavailable. The customer’s list of installed APPs will not be stored in the system background.

(6) The Bluetooth of your current device for Bluetooth-based connection and interaction of your mobile with the third-party device. Without authorization, the hardware wallet functions will be unavailable. The customer’s mobile Bluetooth configuration information will not be stored in the system background.

(7) The NFC for connection and interaction with the hardware wallet, merchant receiving tags and mobile. Without authorization, the hardware wallet and Tap-to-Pay will be unavailable. The customer’s mobile NFC configuration information will not be stored in the system background.

(8) The network communication for communication with the server. Without authorization, all functions of mobile banking that require internet access will be unavailable. The network information on the device used by the customer during transactions is stored in the system background, including IP address and port information.

For the above functions, you may need to permit us to access your camera, geographical location, microphone, Bluetooth, SMS of your mobile, NFC, network communication and contact list in your device to enable the collection and use of information related to such functions. Please note that by granting such permissions, you have authorized us to collect and use relevant information to enable the above functions. If you cancel these authorizations, we will not continue to collect and use your information, nor can we provide you with the above functions requiring these authorizations.

If your information is collected or used under other circumstances than the above mentioned, we will seek your prior consent according to law and fully inform you of the purpose, method, scope and period of storage of information collection and use, as well as the method and procedure for exercising your rights.

ii.How to use information

1.Your information will be used to maintain and improve the above functions when we provide you with our financial products or services with your authorization and consent.

2.You authorize us to collect and use your information throughout the period when we provide continued financial services to you. When you cancel the service or disable any business function, we will stop collecting your related personal information. Please understand that we will continue to use your personal information collected previously in the aforesaid fields to cooperate with the statistical and file management activities organized and carried out by competent authorities, conduct audit activities in accordance with the law and fulfill the obligations of assisting regulatory investigations, but we will take strict protection measures.

3.To improve your product or service experience or prevent risks, we will summarize, statistically analyze and process data about your use of our services. But such data will not contain any of your identification information.

4.In order to keep you informed of the financial products or services used, or help you further understand our services, we will send you service status notices.

5.Other purposes authorized by you and permitted by law and administrative regulations, e.g., to fulfill anti-money laundering obligations or comply with the requirements of competent authorities for identity-verified account management.

iii.Exemptions from authorization and consent

According to relevant laws, regulations, regulatory requirements and national standards, we may collect and use your relevant personal information under the following circumstances without your authorization and consent:

1.Directly related to national security and national defense security;

2.Directly related to public safety, public health and major public interests;

3.Directly related to criminal investigation, prosecution, trial or enforcement of court order;

4.To protect your or other persons’ life, property or other major legitimate rights and interests, where your authorization or consent is hard to be obtained;

5.The collected personal information is what you have disclosed to the public by yourself, except where you explicitly refuse or where our collection or use of the information infringes your vital interests;

6.Personal information collected from lawful disclosure channels, such as news reports and government information disclosure channels, except where you explicitly refuse or where our collection or use of the information infringes your vital interests;

7.Necessary for signing and performing a contract at your request;

8.Necessary for maintaining the safe and stable operation of the products or services provided, such as discovering and handling the product or service faults; or

9.Other circumstances prescribed by laws, regulations and regulatory requirements.

 

II.How does the Bank use cookies and similar technologies?

i.Cookies

To ensure the normal operation of the website, we will store small data files called cookies on your computer or mobile device. Cookies usually contain identifiers, site names, and some numbers and characters. With cookies, websites can store your preferences. The Bank will not use cookies for any purposes other than those stated in this Policy. You can manage or delete cookies according to your preference. You can clear all cookies saved on your computer. Most web browsers have the function of blocking cookies. If you block the cookies, you have to change the user settings every time you visit our website.

ii.Do not track

Many web browsers have the “Do Not Track” function and can send the “Do Not Track” request to websites. At present, major Internet standard organizations have not set up any policy on how websites should respond to such request. However, if your browser enables the “Do Not Track” function, all our websites will respect your choice.

 

III.How does the Bank share, transfer and publicly disclose your personal information?

i.Sharing and transfer

1.We will not share or transfer your personal information to any other company, organization or individual without your separate consent or authorization.

2.If your personal information shall be shared or transferred for business purposes, we will inform you of the purpose of such sharing or transfer, the manner of processing, the type of personal information and the name and contact information of data recipient and solicit your separate consent.

3.Please understand that we may share your personal information with third parties pursuant to laws and regulations or the mandatory requirements of the competent government authority.

4.According to laws, regulations and business practices, if personal information transfer is involved in any merger, acquisition, asset transfer or similar deals, we will require the new company or organization holding your personal information to continue to be bound by this Policy; otherwise, we will require the company or organization to solicit your authorization and consent again.

ii.Public disclosure

1.We will not publicly disclose your personal information. If it is really necessary to do so, we will inform you of the purpose, type and content of disclosure, and solicit your separate consent in advance.

2.Please understand that we may publicly disclose your personal information in accordance with laws, legal procedures or mandatory requirements of competent government authorities.

iii.Exemptions from authorization and consent

According to relevant laws, regulations, regulatory requirements and national standards, we may share, transfer and publicly disclose your relevant personal information under the following circumstances without your prior authorization and consent:

1.Directly related to national security and national defense security;

2.Directly related to public safety, public health and major public interests;

3.Directly related to criminal investigation, prosecution, trial or enforcement of court order;

4.To protect your or other persons’ life, property, reputation or other major legitimate rights and interests, where your authorization or consent is hard to be obtained;

5.The personal information disclosed to the public by yourself, except where you explicitly refuse or where our collection or use of the information infringes your vital interests;

6.User information collected from lawful disclosure channels, such as news reports and government information disclosure channels, except where you explicitly refuse or where our collection or use of the information infringes your vital interests.

 

IV.How does the Bank store and protect your personal information?

i.Storage

1.Personal information collected and generated by the Bank within the territory of the People’s Republic of China will be stored within the territory of the People’s Republic of China. Where it is necessary to provide your personal information overseas, we will, as long as the legal conditions are met, inform you of the name and contact information of the overseas recipient, the purpose of processing, the manner of processing, the type of personal information, and the manner and procedure for you to exercise your rights with the recipient. We may transfer your personal information overseas with your separate consent. Under such circumstances, we will take effective measures to protect your information, such as de-identification of the data before cross-border data transfer, or requiring the overseas recipient to keep your information confidential through an agreement or checking measures.

Storage of biometric authentication information: We will store personal biometric authentication information separately from personal identity information. During facial verification and fingerprint verification, we will not collect your fingerprints and facial information for facial verification services, and your fingerprints and such facial information will only be stored on the device you authorize to collect fingerprints and facial information. The original information on the collection device will be deleted after the use of facial verification and other means for identification and authentication, and only the personal biometric authentication information will be stored on the Bank’s servers.

2.We will only retain your personal information within the time limit required by laws and regulations and within the timeframe necessary to achieve the purposes stated in this Policy. For example:

Mobile number: When you use the e-CNY wallet service, we will keep your mobile number all the time to ensure your normal use of the service. When you close the e-CNY wallet account, we will delete the corresponding information.

User photo: After you set your photo, we will keep your photo for display on the login page. When you choose to restore the default photo, we will delete the photo information you have set.

Biometric authentication information: When you use the services requiring biometric authentication information, the Bank will store your facial information to ensure your normal access to the services, and when you no longer use those services, the Bank will delete the corresponding biometric authentication information.

ii.Protection

1.The Bank has taken security measures in line with industry standards to protect the personal information you provide and prevent any unauthorized access, disclosure, use, modification, damage or loss of data. We will take all reasonable and practical steps to protect your personal information. For instance, we will use encryption technology to ensure data security, apply reliable protection mechanism to protect data from malicious attack, deploy an access control mechanism to ensure authorized access to personal information, and provide training courses on security and privacy protection to enhance employees’ awareness of the importance of personal information protection.

2.If all or part of the e-CNY business provided by the Bank is discontinued, you will be informed of the affected products or services of the Bank in the form of public announcement or others. Meanwhile, relevant products or services will cease to collect your personal information to protect your personal information security. If all or part of the e-CNY business is interrupted due to technical failure, cyberattack, natural disasters and accidents, human factors, etc., we will take emergency response and recovery measures to resume service as soon as possible.

3.We have obtained the following certifications: At present, the Bank has passed the testing and registration for the national classified cybersecurity protection. Our data center has been certified for the ISO27001 standard.

4.We will take all reasonable and practical steps to ensure no irrelevant personal information is collected.

5.Please understand that due to technical limitations and possible malicious attacks, there may be unexpected situations that we cannot reasonably foresee, prevent, avoid or control. Internet is not an absolutely secure environment. Please use complex passwords to help us ensure your account security.

6.If any personal information security incident occurs, we will inform you of the incident in a timely manner by sending email, letter or telephone or pushing notice, or make an announcement in a reasonable and effective way pursuant to laws and regulations. In addition, we will report to regulators on the handling of personal information security incidents in accordance with regulatory requirements.

 

V.Your right to control personal information

In accordance with the relevant laws, regulations and regulatory requirements of China, we guarantee your exercise of the following rights on your personal information:

i.To access, correct and update your personal information

After you log in to the e-CNY APP, you can inquire about your wallet balance and transaction via “Homepage”, and can inquire about the ID information and enabling date of your wallet and manage the category, limit, name, payment PIN, bank card linked and biometric payment authorization of your wallet via “My - Wallet Management”.

You can also access, correct and update your personal information through our mobile banking, e-banking and outlets (the details are subject to the instructions of each channel), except as otherwise provided by laws and regulations. It is your responsibility to update your personal information in a timely manner. We will verify your identity before you modify your personal information. We will ensure the accuracy and effectiveness of information modification through a reasonable verification mechanism.

ii.To delete your personal information

You may request the Bank to delete your personal information if:

1.Our processing of personal information violates any laws or regulations;

2.We collect and use your personal information without your consent or where you have withdrawn consent;

3.Our processing of personal information goes against the agreement we have made with you;

4.You no longer use our products or services, or you close your account with the Bank;

5.We no longer provide you with any products or services or your information storage period has expired;

6.The purposes for which we process personal information have been fulfilled, cannot be fulfilled or your personal information is no longer necessary to fulfill such purposes;

7.Other circumstances as stipulated by laws and administrative regulations.

If we decide to accept your request for deletion, we will also inform the entities that have obtained your personal information from us to delete it in time, unless otherwise provided by laws and regulations, or such entities have obtained your separate authorization.

After you delete your information from our service, we may not immediately delete relevant information in the backup system. However, we will delete the information upon backup update.

If the storage period stipulated by laws or administrative regulations has not expired, or if the deletion of your information is technically difficult to achieve, the Bank will stop processing your information except storing information or taking necessary security protection measures.

iii.To change the scope of your authorization and consent

Some basic personal information is needed to accomplish each business function. With regard to the collection and use of additional information, you may grant or withdraw your authorization and consent any time by enabling or disabling location service, access to contacts and calling, depending on the brand and model of your mobile.

Please note that when you cancel the e-CNY wallet service at your discretion, you will be deemed to have withdrawn your consent to the Bank’s Personal Information Protection Policy for e-CNY service. Upon you withdraw your consent, we will no longer process relevant personal information. However, your decision to withdraw your consent will not affect any previous processing of personal information based on your authorization.

iv.To cancel e-CNY wallet by personal information entity

Please note that you may cancel the e-CNY wallet service through our outlet, self-service machine (including STM and SATM) or e-CNY wallet APP. Functions of the e-CNY wallet will be unavailable after the cancellation.

The path to cancel your wallet from the e-CNY wallet APP is “My - Wallet Management - Click on a Specific Wallet - Cancel Wallet”.

If you are not an e-CNY user of the Bank, you may uninstall or stop using the e-CNY wallet client, in which case, the Bank will no longer access your personal information. Your cancellation of your e-CNY wallet is irreversible. Once you cancel your e-CNY wallet, we will no longer provide you with e-CNY wallet service or collect your personal information through the e-CNY wallet client and will delete the information regarding your e-CNY wallet, unless otherwise prescribed by laws, regulations or regulatory authorities.

Please note that when you delete this APP from your mobile device, we will not cancel your e-CNY wallet, and all information regarding your e-CNY wallet will not be deleted. You can still access your e-CNY wallet by re-installing this APP.

v.To constrain automatic decision-making

For some service functions, the Bank may make decisions only based on automatic decision-making mechanisms, such as information systems and algorithms. If such decisions significantly affect your legitimate rights and interests, you may request an explanation from us, and we will also provide appropriate remedies.

vi.To be answered to your above requests

For security reasons, you may need to provide a written request or prove your identity in other ways. We may ask you to verify your identity before processing your request. Please understand that we may decline your requests which are repeated for no reason, require too much of technical intervention, put others’ legitimate rights and interests at risk or are very unrealistic.

Notwithstanding the foregoing provision, according to laws and regulations, we may not respond to your request under any of the following circumstances:

1.Your request is related to national security and national defense security;

2.Your request is related to public safety, public health and major public interests;

3.Your request is related to criminal investigation, prosecution, trial or enforcement of court order;

4.There is adequate evidence to prove your subjective malice or abuse of rights;

5.Response to your request will seriously impair legitimate rights and interests of yours or of other individuals or organizations; or

6.Our trade secrets are involved.

 

VI.How does the Bank handle the information of minors?

Minors are not allowed to create their own user accounts without the consent of their guardians. If you are a minor, please ask your guardian to carefully read this guide and obtain his or her prior consent to use our services or provide information to us. We will only use and disclose the information to the extent permitted by laws, regulations and regulatory requirements or where it is necessary to protect minors. VII.How does the Bank update this policy?

The Bank’s personal information protection policy may change from time to time. Without your explicit consent, we will not restrict your rights under this Policy.

We will publish any changes in this Policy on this webpage. For major changes, we will give a more noticeable notification (for example, when the APP is remodeled or upgraded or you log in again, we will give you a prompt notice via a pop-up window). You acknowledge and confirm that if you disagree with any updated content, you should immediately stop using relevant services and close the relevant user, and we will stop collecting your relevant personal information. If you continue to use the services, we will act on the updates. If there is any inconsistency between the terms and conditions agreed between the Bank and you in relation to the processing of personal information and this Policy, the separate agreement between the Bank and you shall prevail.

Major changes referred to in this Policy include but are not limited to:

1.Any significant changes in our service model, such as the purpose of processing personal information, the type of personal information processed, and the way of using personal information;

2.Any major change in the ownership structure and organizational structure of the Bank, such as changes in owners resulting from business adjustment, mergers and acquisitions due to bankruptcy;
